These Terms of Service ("Terms") govern your use of NexoMailer, an email delivery service operated by Logic Launch Software Solutions. By using this service, you agree to these Terms.

1. Service Description

NexoMailer is a multi-tenant email delivery platform that sends emails on your behalf using the Gmail API. The service provides API key management, Gmail account pooling, rate limiting, queue management, and email templates.

2. Acceptable Use

You agree to use NexoMailer only for lawful purposes. You must not:

• Send spam, unsolicited bulk emails, or phishing emails.
• Send emails containing malware, viruses, or malicious content.
• Impersonate any person or entity in emails sent through the service.
• Violate any applicable laws, regulations, or third-party rights.
• Exceed rate limits or attempt to circumvent service restrictions.
• Use the service to harvest email addresses or personal data.

3. Google API Compliance

By connecting a Gmail account, you authorize NexoMailer to send emails on your behalf. Your use of this feature is subject to:

• Google API Terms of Service
• Google API Services User Data Policy
• Google Terms of Service

You are responsible for ensuring your Gmail account usage complies with Google's policies and sending limits.

4. API Keys & Security

• You are responsible for keeping your API keys confidential.
• Any emails sent using your API key are your responsibility.
• Report compromised keys immediately and regenerate them via the dashboard.
• We reserve the right to disable API keys that are used in violation of these Terms.

5. Rate Limits

The service enforces rate limits per Gmail account to comply with Google's sending policies:

• Workspace accounts: Up to 2,000 emails/day, 30 emails/minute.
• Standard accounts: Up to 500 emails/day, 20 emails/minute.

These limits may change. Emails exceeding limits are queued and delivered when capacity is available.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The service is provided "as is" without warranties of any kind. We are not liable for:

• Email delivery failures caused by Google API outages or policy changes.
• Emails rejected by recipient mail servers.
• Data loss due to server failures or unforeseen circumstances.

7. Limitation of Liability

To the maximum extent permitted by law, Logic Launch Software Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost profits, data loss, or business interruption.

8. Termination

We reserve the right to terminate or suspend access to the service at any time, with or without notice, for violations of these Terms or for any other reason.

9. Changes to Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the service after changes constitutes acceptance.
